For Now Appeals Court Lifts Publication Block Against Simon & Schuster, But Not Mary Trump
New York State Appeals Court Justice Alan Sheinkman has lifted the order blocking Simon & Schuster from distributing and publishing Mary Trump’s. But like that original order, the relief is temporary as well, lasting until the scheduled Dutchess County Court hearing on July 10. For now, Justice Scheinkman found that “S&S is not a party to” Mary Trump’s settlement agreement with the Trump estate. “Unlike Ms. Trump, S&S has not agreed to surrender or relinquish any of its First Amendment rights. Since the predicate for the plaintiff’s application for a temporary restraining order is the existence of the confidentiality provision […]
Elliott’s Defamation Suit Against Moira Donegan Moves Forward to Limited Discovery
Judge LaShann DeArcy Hall has denied “Sh—y Media Men List” creator Moira Donegan’s motion to dismiss the defamation lawsuit against her by Stephen Elliott, one of the men who made the list. Donegan might ultimately be entitled to immunity under the Communications Decency Act, but Judge DeArcy Hall ruled on June 30 that the facts in Elliott’s complaint weren’t sufficient to throw the case out on that basis. Instead, the parties will “proceed without delay to narrowly tailored discovery to address factual issues related to Defendant’s CDA immunity defense. Once such discovery is completed, the parties may move for summary […]
“What It’s Like to Be Black in Publishing”
The NYT interviewed eight people from across publishing, who “told us what they are seeing now and what they’ve seen before, how being Black has affected their careers, and what they hope the future will bring.” Editorial director at Amistad, Tracy Sherrod: “There’s only like seven of us Black editors who have some authority, real authority and power — and it’s not full authority and power. Given my sales history, I think if I weren’t a Black woman, I would probably have a higher title….” “I don’t feel comfortable overpaying for a book as an editor of color. I feel […]
Briefs: Strong Opening Sales for Bolton
Simon & Schuster announced Wednesday morning that John Bolton’s THE ROOM WHERE IT HAPPENED: A White House Memoir sold “a total of more than 780,000” units in its first week on sale in the US. Note, however, that the total includes “orders from consumers that are as yet unfulfilled due to extraordinary demand,” which is unusual for a “sales” tabulation by industry practice. (Remember that the publisher told the court it had shipped approximately 200,000 copies to accounts in the US.) The publisher says it has an eleventh printing on the way that will bring the number of hardcovers in […]
